KMoney, you should ask this question to a credit lawyer. I don't know if that's what they're called but there are attorneys just for credit.
Yes I think your right. I do know that I am past the SOL for this debt. One judgment I have almost paid off but still once I started paying it, they immediately removed it from my credit report

Can I dispute these items if they are still on my credit report? Or should I let sleeping dogs lie and just let them fall off on their own?
Is this 6 year statute supposed to erased the debt off my report? Or does it just make me not responsible for the debt?
From what I understand the statue of limitations refers to the length of time the debtor has to pursue legal action to collect a debt. The website I listed earlier explained it this way...
Generally, a creditor or debt collector gives up his right to file suit to collect a debt after a period of six years from the time the debt was written off (or the date of last activity on your credit report), but various states allow anywhere from 2 to 15 years to collect delinquent debt (see statutes of limitation table below).
But I think they still stay on your credit report for the 7 years...I don't know about the disputing thing...I know someone on here does though...there are very smart people on this site I know they can help you out!!

I have been searching for websites trying to figure out what the heck the Statute of Limitations is in NY for credit card charge offs. I keep getting caught up in the legal mumbo jumbo and I don't understand what any of it means. Can one of you direct me to a website that is meant to be read by the layperson???

ps, i was under the impression that if a charge-off is past the statute of limitations, they cant come after you with a judgement (at least thats what my attorney informed me off)... its weird that you still were pending a legal matter....

if there's one thing in law school that i've learned is that almost nothing is set in stone. almost everything can be appealed, especially in civil judgements - even more easily if the judgement was in default.
Have I been spelling judgment wrong this whole time???

Double check with the laws in your state. You also want to make sure that the motion is formatted correctly...there should be tons of resources on the web. The court may also require a fee to file.
